should help you out I'll confess that I haven't dug quite as deep into your example as maybe I should, but whenever I see code-behind that's searching the visual tree, I think, could this be handled more explicitly in a view model?
It seems to me in this case that you could come up with a pretty straightforward view model - an object exposing Text, Image, Command, and Children properties, for instance - and then create a simple data template that for presenting it as a MenuItem. Then anything that needs to alter the contents of your menus manipulates this model.
code :
string Text
Uri ImageSource
ICommand Command
ObservableCollection<MenuItemViewModel> Children
<Menu DockPanel.Dock="Top" ItemsSource="{DynamicResource Menu}"/>
<HierarchicalDataTemplate DataType="{x:Type local:MenuItemViewModel}"
                          ItemsSource="{Binding Path=Children}">
    <HierarchicalDataTemplate.ItemContainerStyle>
        <Style TargetType="MenuItem">
            <Setter Property="Command"
                    Value="{Binding Command}" />
        </Style>
    </HierarchicalDataTemplate.ItemContainerStyle>
    <StackPanel Orientation="Horizontal">
        <Image Source="{Binding ImageSource}" />
        <Label Content="{Binding Text}" />
    </StackPanel>
</HierarchicalDataTemplate>

I wish did fix the issue. The solution here is sufficient for my needs, even though it doesn't use databinding, but an array of menuitems as a resource.
It would still be interesting theoretically to know if this is possible somehow.

will be helpful for those in need Well, it turns out it depends on OS level.
For instance, on OS 4.7 "Switch Application" is always in the bottom section near the "Close". However if you open any native BB app in OS 6 simulator, then you'll see RIM changed the this behaviour - "Switch Application" is always in the top section while they left "Close" in the bottom.
code :
new MyMenuItem("Above Switch Application", 0 /*ordinal*/, 0);
